[欧州]　EMC指令/低電圧指令施行、整合規格

2016年4月20日にEMC指令 2014/30/EU、低電圧指令2014/35/EUなどは移行期間なく施行されています。この日以降は新指令に基づく適合宣言、テストレポートの作成が必要です。整合規格が施行日に発行されなかったのは、もともとこれら指令に対しては整合規格を使用する義務はなく、必須要求事項の参考として参照することが出来たためです。また、欧州委員会は技術要件の変更はないと見做しています。従って、指令だけを新指令とし、適合規格は従来通りの選択で問題はありません。

EMC指令変更概要は以下となります。

  • 対象はオンラインを含むEUに出荷されるもの
  • 対象機器は、「あらゆる装置」又は「固定機器」、「移動設備」であり、電気通信端末機器が対象となった
  • 対象外はR&TTE(RE)指令に含まれるもの等、RE指令施行までは放送受信機は対象
  • 経済担当者の役割の明確化(RE指令共通)：製造者、現地代表者、輸入業者、流通業者の考え方は以前同様(必須となった)
  • 適合ルートに変更なし
  • 定義の追加：電磁妨害の明確化等　新規17個
  • 複数のDoCの扱い：パッケージとして適合宣言するのは最終出荷者の責任であり適合推定を使用者にさせてはいけない
  • CEマーキングはReg.765/2008に準拠：5 mm以上要求(ただし無理な場合、関係文書を含め製品上でなくとも可)
  • リスク評価は通常、整合規格(旧指令を含む)のみで十分：ただし検証の義務がある
  • NBの義務の増加

また、EMC指令ガイドのドラフトが関係団体に開示されています。内容的には、Blue Guideへの整合が主なものであり、当然要求事項に変更はありませんが随所に細かな変更が見られます。Place on the MarketとPutting into Servicesの関係の明記、指令で必須となっている経済担当者の義務についてはBlue Guideを参照すること、リスク分析についての記載、加盟国にとって市場監視は義務であることなどの追記が行われています。リスク分析は整合規格を用いた場合でも現象から判断する必要がありますが、EMC指令の必須要求事項は必ずしも“安全性”を意図していません。

 

2016年4月20日に以下整合規格が発行されています。

[米国]　DA 16-348(ANSI C63.26)

2016年4月20日　2016年4月1日に発行された、ANSI C63.26-2015をライセンス使用機器に対する測定規格として認めるかの意見募集を行うDA 16-348が官報に掲載されました。2016年5月5日までコメント募集が行われます。

[カナダ]　RSS-247

カナダISEDはRSS-247 のドラフトをTCB(FCB)など関係団体に対し開示しています。内容的にはW58の移行、限度値適用の猶予などFCCへの整合が主なものとなります。

コメント期間は2016年5月20日までとなっています。

[日本]　MRA法省令改正

2016年4月20日に総務省及び経済産業省は特定機器に係る適合性評価手続の結果の外国との相互承認の実施に関する法律(MRA法)施行規則の一部を改正する省令を発行しました。これは、R&TTE指令からRE指令への移行を主たる目的とするものです。法律改正の時期から考えると、監査がこれ以降要求されるため、UL JapanがR&TTE指令からRE指令のNotified Bodyとして通知されるのは残念ながら2016年6月13日以降になるものと思われます。しかし、今回、R&TTE指令からRE指令の移行に関して、現地点で不明確なRE指令を2016年6月13日以降使用するよりも、明確な要求事項を示すR&TTE指令での適合宣言を移行期間の2017年6月12日まで行うことが推奨されます。現時点でガイドラインなど参照とする文書が少なく、適合性推定に関して疑義が生じる可能性があるためです。経済担当者(製造者、輸入業者)が関わる2017年7月13日以降の新規市場導入は適合宣言書等の書き換えが要求されますが、移行期間を最大限生かし準備を進めることが望ましいと思われます。

 

[AS/NZ]　Radio Standards Notice 2016、ホワイトスペース

2016年4月14日にニュージーランドRSMは2015年2月12日に発行されたRadiocommunications Regulations (Radio Standards) Notice 2016を更新しました。

変更点は、5.9 GHzを超える固定無線サービスの追加等です。
